Terms of Service

1. Acceptance of Terms
By accessing or using the AppraisalFix platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including loan officers, homeowners, handymen, appraisers, and administrators.
2. Description of Service
AppraisalFix provides a platform to coordinate appraisal-required repairs, match jobs with qualified handymen, document completed work, and facilitate certification of completion (including the 1004D). AppraisalFix is a coordination and software platform; it does not itself perform repairs and is not a party to the underlying loan transaction.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to keep it updated. Loan officer and administrator access may require invitation and verification.
4. Handyman Obligations
Handymen using the platform represent that they hold all required licenses and insurance, will perform work in a professional and workmanlike manner, and will comply with all applicable laws and codes. AppraisalFix may verify credentials but does not guarantee the work of any contractor. Handymen are independent contractors and not employees or agents of AppraisalFix.
5. Payments and Funding
Where the platform facilitates funding or payment for repairs, all amounts, fees, and timing will be presented before you proceed. You agree to pay all applicable charges. Pre-funding or escrow arrangements, where offered, are subject to additional terms and lender approval.
6. Documentation and Compliance
You are responsible for ensuring that information you submit (including appraisal documents, repair details, and photos) is accurate. AppraisalFix facilitates the preparation and submission of completion documentation but does not provide legal, lending, or appraisal advice, and is not responsible for lender or appraiser decisions.
7. Acceptable Use
You agree not to misuse the Service, including by submitting false information, infringing intellectual property, attempting to gain unauthorized access, interfering with the platform's operation, or using the Service for any unlawful purpose.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. AppraisalFix does not warrant that the Service will be uninterrupted, error-free, or that repairs coordinated through the platform will satisfy any specific lender, appraiser, or regulatory requirement.
9. Limitation of Liability
To the maximum extent permitted by law, AppraisalFix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid to us for the Service in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless AppraisalFix and its affiliates from any claims, damages, liabilities, and expenses arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these terms or for any conduct we believe is harmful to other users or the platform. You may stop using the Service at any time.
12. Governing Law
These terms are governed by the laws of the United States and the state in which AppraisalFix is organized, without regard to conflict-of-law principles.
13. Changes to Terms
We may modify these Terms of Service from time to time. We will post the updated terms on this page with a new effective date. Continued use of the Service after changes constitutes acceptance of the revised terms.
